Agreement to Terms

These Terms of Use ("Terms") are an agreement between you and Simon Grimm, Germany ("we", "us"), the developer of Tiny Squares ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

The App is made for children. If a child uses the App, the parent or guardian accepts these Terms on the child's behalf and is responsible for any purchases.

Our Privacy Policy explains how we handle your data and forms part of these Terms.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for personal, non-commercial use.

This license does not include the right to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App, except where the law allows it
• Remove any proprietary notices or labels
• Copy, sell, or redistribute the App's content, such as its pictures, colour-by-number templates, bead patterns, stickers, and sounds

Your Paintings

Paintings made in the App belong to you. You are free to keep, print, share, and turn them into real bead crafts. Paintings are stored only on your device. We have no copy of them and cannot restore them if they are lost, for example when you delete the App.

No Accounts

The App has no accounts, no chat, and no online or social features. It works fully offline and does not collect personal data.

Purchases

The App is free to download. An optional one-time in-app purchase, "Unlock Everything", unlocks all premium content described in the App, including content we add later. It is not a subscription and does not renew. Purchases are placed behind a parental gate.

• All purchases are processed by the Apple App Store and are subject to Apple's terms. Prices are shown in the App before you confirm a purchase and may vary by country.
• Refunds are handled by Apple under its refund policy; we cannot issue refunds directly. You can request one at reportaproblem.apple.com.
• What you buy is a license to use the unlocked content in the App, not ownership of it.
• Family Sharing is enabled, so up to six family members can use the purchase.
• If a purchase does not appear, for example on a new device, use "Restore Purchases" in the App or contact us.

The purchased content is unlocked immediately. If you are a consumer in the EU, by confirming the purchase you ask us to deliver the digital content immediately and acknowledge that your right of withdrawal ends once delivery has started.

Changes to the App

We continue to improve Tiny Squares and may add, change, or remove features and content. We will not intentionally remove content included in "Unlock Everything" without good reason. We may also need to stop offering the App in the future.

Disclaimer of Warranties

The App is provided "as is" and "as available". To the extent permitted by law, we make no warranties that the App will be uninterrupted, error-free, or free of harmful components. Your statutory rights as a consumer are not affected.

Limitation of Liability

We are fully liable for damage caused intentionally or through gross negligence, for injury to life, body, or health, and where liability is mandatory by law (for example, under the German Product Liability Act).

For slight negligence, we are only liable if we breach an obligation that is essential for the proper use of the App and that you may regularly rely on, and then only for typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

Termination

You can stop using the App at any time by deleting it. We may end your license if you seriously break these Terms.

Apple App Store

These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content, maintenance, support, and any claims relating to it. The App is also licensed to you under Apple's Licensed Application End User License Agreement. In addition:

• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, or consumer protection claims.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

Changes to These Terms

We may update these Terms, for example when we add features or when the law changes. We will post the new version on this page and update the "Last updated" date. If you keep using the App after a change takes effect, the updated Terms apply.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
